Terms and Conditions – Swimming lessons with Canyon Aqualife Swimming This page details the important notes which relate to the swimming lessons offered at several different venues by the swim club “Canyon Aqualife Swimming.” By booking or attending a swimming lesson and/or course with Canyon Aqualife Swimming, you automatically accept these terms and conditions, and they are a part of the contract between you and the club. Please ensure you follow the general swimming pool rules and/or any facility specific rules. We reserve the right to vary these terms and conditions at any time. All customers are expected to abide by the terms and conditions laid out below. In the unlikely event of failing to do so, a customer may be requested not to continue lessons with Canyon Aqualife Swimming. A refund will not be eligible under these circumstances. Please read carefully before booking/starting your lessons and/or course. 1.Organizing Swimming club “Canyon Aqualife Swimming” is licensed with the City of Edmonton. “Canyon Aqualife Swimming” has a tax Business Identification Number with the CRA. 2.Risk and Health All students are obliged to fill out the registration form, disclosing any health conditions/information which may concern and/or affect the swimming lesson and/or course. All relevant historical background information needs to be mentioned while enrolling. Attendance at the swimming lesson and/or course is at your own risk. Canyon Aqualife Swimming must be in possession of at least one phone number in case of an accident/incident. 3.Safety and General Rules Swimmers are responsible for their own safety, actions, and behavior on any part of the swimming pool property, including the changing area. Please do not change children on deck. Outdoor shoes must be removed prior to entering the poolside/pool deck or overshoes must be worn if one has one. Safety for all is of paramount concern to us and we have the right to remove anyone on, in, or around the pool who gives us any concern whatsoever regarding safety. Swimmers must not run, act inappropriately or participate in horseplay within the pool vicinity. We shall not be responsible for any injury/accident caused as a result of you and/or other students disobeying these rules. Canyon Aqualife Swimming does not accept any liability for sickness, personal injury, or death of any participants unless directly caused by the proven negligence of the club or its employees. Organizers providing the facility and their servants are under no liability whatsoever in respect to personal injuries, loss, or damage to property whilst attending any Canyon Aqualife Swimming lesson and/or course. It's essential to note that class begins promptly at the scheduled time, not when the student arrives. We must clarify that makeup classes due to lateness or personal reasons are not typically available. We understand that unforeseen circumstances may arise, but our policies are in place to ensure the smooth operation of our classes for the benefit of all students. 4.Reference Swimming Education Canyon Aqualife Swimming follows the swimming guidelines as set by ‘SwimAmerica’ to build up the lessons. Canyon Aqualife Swimming is allied to hand out ‘SwimAmerica’ certificates and is internationally acknowledged by the ASCA. 5.Student Registration and Rules While enrolling you allow and authorize Canyon Aqualife Swimming to invoice you for registration fees, station fees and receive payments. You are not registered by merely sending registration form. The student is registered once the payment is received. These payments will remain unchanged regardless of your attendance. After each station ends, an invoice will be generated on the same day that the station ends, and it is due on receipt. If the invoice is not paid, it will be deemed that the student is not continuing in our program and the registration will be cancelled. The spot will become available for others on the waiting list. Should registration be canceled at any point due to non-payment or failure to comply with our policies, the student will not be permitted to re-register in our program, unless there are exceptional circumstances. If you discontinue during the first station or withdraw your child from our program after the two stations or 10 (ten) classes, you will have to pay a fee of $85.00 for the swim gears that we provided Our class size does not exceed 5 students with the exception of when there are siblings, whom we don't separate. The student’s registration will remain in effect until Canyon Aqualife Swimming is notified in writing at least one month in advance of their cancellation. All students will receive a cap, goggles, and a swimsuit after signing the Canyon Aqualife Swimming’s registration form and upon payment of the registration fee and Station 1 fees. This is the only acceptable swimwear for students in the SwimAmerica program and must be worn during all classes, including the cap. You can put prescription in our goggles, but personal goggles are not allowed. This swim attire is provided for the duration of the SwimAmerica program, and no new attire will be provided for free. No new swim cap will be provided if you lose or damage it within 3 months. We are not liable for any bodily changes during long periods of break from the program, hence requiring new swimwear. This swimwear is not to be worn to other pools for the sake of recreation, it is solely meant for our program. We are not responsible for any loss or damages that may arise if our gear is taken elsewhere. * Every swimmer must shower before entering the pool and are not permitted to run on the deck. Parents may email our club with questions, as Coach cannot answer questions at the pool. If a student is not going to attend their class, administration should be contacted via email, not by text messages or phone calls. Students who receive a discount at the time of registration or after completing a program will not be provided make-up classes. * SwimAmerica swimwear and certificate clause is not applicable to adult learners. All adult learners must wear proper swim attire specifically used for swimming. All female adult learners must wear a one-piece swimsuit, no exceptions. Adults who got a discount cannot postpone their classes for their personal conveniences for more than two weeks. Adults who are enrolled with a discount on a periodic basis due to circumstances that won’t allow them to attend regularly as per club schedule and if the club is not contacted to set classes for over two weeks, registration will be cancelled, and classes will be forfeited. 6.Cancellation and Rescheduled Lessons We always try to be as flexible as possible within our operational constraints. The swimmer can request to change the lesson time, day, or pool by email. We will endeavor to accommodate each request, subject to a space being available. Cancelling or rescheduling a lesson by phone or verbally is not possible. Lessons cancelled within 8 hours will be charged. Canyon Aqualife Swimming does not have the possibility to reschedule the lesson with such a short notice seeing that payments for renting the pool and the instructors are already made. This is the only way we can offer the highest level of instruction in small groups. Most importantly, we are a learning institution that does not revolve around anyone's personal life and if you miss a class for personal reasons (like travel, weddings, parties, vacations, etc.) a make-up class will not be provided. If you are not registered in the program, you will not get a make-up class if registration is cancelled. A student's limit for receiving makeup classes should not exceed 10 makeup sessions in the program. Students who receive a discount at the time of registration or after completing a program will not be provided make-up classes. Students may miss a class, but not the lesson, as Coach will always start from where the student left off before their absence. Students are unable to transfer classes between individuals for any reason. Classes will be forfeited otherwise. 7.Lesson Cancellation by Management We will make every effort not to cancel a lesson, but the management has the right to alter the time of a lesson and/or course, when necessary, in case of staff sickness, essential pool maintenance or pool closure or any other unforeseen circumstances. There will be events at facilities we run our lessons out of and on those days, no class may be conducted. We support our athletes who are competing to own the podium. When a class is not conducted, it will not be counted as a class. Such circumstances are referred to as “force majeure.” In such a case, no refund will be issued. We shall give you as much notice as possible of any such cancellation. We shall not be liable for any losses of any kind incurred by the student as a result of such cancellation. We will cancel/refuse admission if you dictate terms on how we should conduct lessons for your child/children. Our Program Director/Coach has spent years learning how to write programs, how to enhance swimming skills, how to improve stroke technique and how to build an effective training environment. Unless a parent has the same skills, experience, knowledge and commitment to coaching, it is unlikely the parents’ opinions on technical matters are as valid as the coach's. Parents who try to force coaches to push their kids ahead to the next level of development before they are ready are not helping the child (or the coach) and we reserve the right to cancel their admission. Also, If, at any time during the class or class day, the pool is closed, we shall not be held responsible, as the facility is under the ownership of the city, and we have no control over its operation. 8.Privacy All personal information of our students will be treated with respect for privacy and will not be shared with third parties unless we are forced to act otherwise according to the law. At times, our instructors may take photographs and/or videos at the swimming class venues, which may be used for marketing, promotional purposes online or educational purposes. By joining any of our swim programs, it is deemed that you have authorized Canyon Aqualife Swimming to publish photographs taken of you or on behalf of a minor, for use in print, online, video based marketing, and other publications in connection to the swimming program. You further acknowledge and agree that participation is voluntary and that no financial, rights of ownership, or royalties will be gained due to the publication or use of these said photos. You hereby declare that Canyon Aqualife Swimming, its employees and any third party involved has full use of these photos in the creation or publication of marketing materials and confirm that no liability for any claims by me or any third party in connection with the participation will occur on use, now or in the future. The content of all the pages of the website is for your general information and use only. It is subject to change without notice. Neither Canyon Aqualife Swimming nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the website for any particular purpose. All property left at any Canyon Aqualife Swimming venue whether it is in a changing room, on poolside, left in entrance halls or outside, is done so at your own risk. Canyon Aqualife Swimming cannot accept any responsibility for the loss or damage of any personal belongings. 10.Cancelling Membership Cancellation of the membership is only possible with a written notice and a one-month notice period, which starts at the end of each station. During this period, your payment will continue. Please make sure you utilize this time frame to catch up with missed classes since they are not refundable. 11.Complaints Canyon Aqualife Swimming is fully committed to delivering the highest standards of teaching, coaching. If you are not entirely satisfied with the service that Canyon Aqualife Swimming provides, we would like to hear about it. If we become aware of any problem while you are still attending a course or activity, we will aim to resolve this at an early stage. You can be assured that any complaint will be taken very seriously and treated with the utmost professionalism. However, abusive or insulting language will not be tolerated at the time of bringing a complaint to the attention of any administrators or staff. 12.Governing Law Canadian law shall govern these terms and conditions and you agree that any disputes shall be resolved exclusively by the Canadian courts. 13.Acceptance of Our Program If you sign the registration form, you have deemed to have accepted our terms and conditions.
